The woman, who returned to South Korea, cited privacy and intimidation concerns. But Chahal's lawyer James Lassart said the woman had a public Instagram account and was therefore not concerned with privacy.

  • Sometimes inaudible 911 calls the woman made the night of the alleged assault, in the last of which she states that she called by mistake. Witnesses who testified that she was engaged in a sham marriage for immigration purposes and described her as drinking heavily on the night in question.

Federal law provides that an alien (someone who is not a United States citizen or national) who is convicted of a domestic violence offense may be deported. An alien who violates a domestic violence protective order is also deportable.

In her case, Pollie Pent, an investigator for the District Attorney’s Office said, " The victim was unable to attend hearing because she was “very concerned about her immigration status” and “expressed concerns about safety. The victim later moved from San Francisco to Seoul, South Korea. Pent was able communicate through phone and e-mail."
