A new executive order by former U.S. President Donald Trump has thrown thousands of Indian immigrant families into uncertainty by denying automatic U.S. citizenship to children born to temporary foreign workers.

For Akshay and Neha, an Indian couple living in San Jose on H-1B visas, the announcement is a direct blow to their long-term plans. Expecting their first child in late February, they had assumed their baby would be a U.S. citizen—until now.

A federal judge in Maryland has temporarily blocked the order, but legal challenges continue, leaving families in limbo. "If the order takes effect, we don’t know what comes next," Akshay said. "What nationality will our child have?"

Indian immigrants, who make up a significant portion of H-1B visa holders, are particularly impacted. With green card backlogs stretching decades, many have relied on birthright citizenship to secure their children's future in the U.S.

Medical professionals warn against early C-sections for the sake of citizenship, and immigration attorneys highlight the legal gray areas this order creates.

With uncertainty mounting, expecting parents like Priyanshi Jajoo, due in April, are left scrambling for answers. "Do we need to contact the Indian consulate for a passport? There’s no clear information," she said.

For now, the fate of thousands of immigrant families remains uncertain, with legal battles ahead.
