NRI JASSI SIDHU MURDERED CASE

Jassi had her throat slit and body dumped in a canal after she and her husband were attacked by a group of armed men during a trip to India in 2000.

Additional District and Sessions Judge Smriti Dhir framed charges against Malkiat Kaur and Badesha under sections 302 , 307 and 120-B . After   they were extradited, Sangrur police had submitted a supplementary chargesheet against both of them in the Malerkotla court, and later the case was transferred to the Sangrur court.

In coming days, 23 witnesses of prosecution would be produced in court. The witnesses include police officers and other residents, who had played some role in the case,

Two NRI Malkit Kaur Sidhu, 70,  and her brother Surjit Singh Badesha, 75,  have been extradited to India to face conspiracy charges after they allegedly hired men to kill a NRI young woman Jassi Sidhu and her new husband ,Sukhwinder Singh Mithu.

Malkiat Kaur Sidhu is the mother of Jassi Sidhu. NRI Jassi  from BC, Canada went to India, lived in Mama’s house  and  married Mithu secretly in March 2000. In May 2000, Jassi Sidhu went to India again with the intention of bringing her husband, Sukhwinder “Mithu” Sidhu, to Canada. The couple was attacked on June 8, 2000. He survived, but her body was found several days later.

Malkit Kaur Sidhu,  and  Surjit Singh Badesha were escorted to India by the RCMP and Canadian consular officials in Delhi hand over  the pair to Punjab Police.


DSP, Ahmedgarh, Palwinder Singh Cheema  of Sangrur police said, “They will now be presented before the Illaqa magistrate at Malerkotla tomorrow, and  a police remand for the accused will be taken.

Interestingly, in a unanimous decision in 2017, the Supreme Court of Canada set aside a B.C. Court of Appeal ruling that stopped extradition proceedings over concerns the mother and uncle would be poorly treated or even tortured in India.

The B.C. Appeal Court halted the extradition last year when the pair’s lawyers filed a last-minute court application, bringing them back to B.C. from Toronto before they were to be escorted to India.

“The evidence from the record of the case is that Mr. Badesha and Ms. Sidhu threatened Mithu on multiple occasions, telling him he would be killed because Jassi had married him against their wishes,” Strachan said in her final arguments.

After spending three years in jail, additional Sessions Judge A.S. Grewal acquitted him of all charges. He was falsely booked for raping the girl and and sent to the Jail in August 2004.

Last week, none other than the rape victim girl had deposed before the judge. She said she had named Mithu as the rapist at the behest of two Kaunke Kalan village-based uncles of the NRI girl.

She said, “I named Mithu under the pressure of the influential uncles of Jassi. I don’t know on what statement the police got my signatures. Later, when we learnt that innocent Mithu had been booked and arrested, they threatened that we would meet the same fate as Jassi.”

Her sister who was witness for the rape complainant, also refused to go against innocent Mithu.

Bikram Jit Singh Sidhu, Mithu's lawyer said, "Today was a red letter day for justice. But who would return over three years of his life wasted in the jail when he was already emotionally distressed at the murder of his NRI wife.”

According to local media, Mithu said:

  • I had been fighting to live with my love (Jassi) first, then I fought death to survive the attack. No one has paid as heavily for love as I have. I have fought the police, the false cases, but finally the law of the land has come to my aid. My struggle would, however, only end when parents of Jassi are extradited to India and pay for the crime.
  • What crime had I committed for loving Jassi. I married her and took her to my small house. I never married her for her social status or money. Her relatives punished us, ‘as it was the biggest crime in the world. I want to ask those helping them, including the contract killers, the cops and many others as to why they helped her relatives in their crime against love
  • Parents and relatives of Jassi managed to throw him in jail after they failed to eliminate him or buy him. As I was pressing hard for punishment to the killers and extradition of parents of Jassi, they tried their best to buy me. I was offered over a crore of rupees to stop pursuing the matter. But nothing could buy my love for Jassi. It is now the prerogative of Mithu to file a petition before the court seeking action against those, including relatives of Jassi and police officials , who falsely implicated him.
