Pay in dollars if plea is found frivolous, court tells NRI

The Gujarat High Court Monday told a non-resident Indian (NRI) petitioner to be ready to pay costs in dollars if his petition is dismissed on grounds of being a frivolous one.

The court was hearing a public interest petition (PIL) filed by Kolkata-based NGO People for Better Treatment (PBT) on the issue of former Medical Council of India (MCI) chief Ketan Desai's election to the Gujarat University senate.

Kunal Saha, who filed the petition on PBT's behalf, is based in the US. The court came down heavily on his counsel and sought to know the "intent and interest" in filing the PIL.

The court wanted to know from counsel as to what made Saha file a petition in public interest here.

"Did he not find anything worth public interest over there," asked the court.

Chief Justice S.J. Mukhopadhaya told his counsel that if, after hearing the case, the petition is dismissed for lack of public interest and being a frivolous one, then the costs would be imposed in dollars.

Ketan Desai's licence suspended

New Delhi, October 10, 2010

The Board of Governors of the Medical Council of India (MCI) has suspended the licence of tainted former MCI chief Ketan Desai, a council official said on Sunday.

The MCI announced the suspension in a letter to Desai on Saturday, ending speculation surrounding his proposed visit to Canada to represent India in a World Medical Association (WMA) conference Oct 13-16.

“In view of the grave and serious allegations against you having a prima facie merit, permission granted to you to practice medicine be suspended during the pendency of appeal/complaint with the Board of Governors in Supersession of Medical Council of India,” the letter from the board said.

This would debar “you from practicing medicine and participating as a doctor in a medical conference anywhere representing doctors in any medical council, conference and association”, it said.

The MCI decision came after an application by Kunal Saha, president of an association of physicians, People for Better Treatment, demanding that Desai be stopped from taking part in the Canada conference and his licence be cancelled. The letter highlighted that the Gujarat Medical Council did not respond to Saha’s appeal on Desai’s involvement in corruption cases.

“He (Saha) has also stated in his appeal that the Medical Council of Gujarat has not responded to his complaint as you (Desai) are the president of the Gujarat Medical Council and he (Saha) has apprehensions that he will not get justice from the Medical Council of Gujarat,” the letter said.

Desai was removed from his post of MCI chief and the body was replaced by the board of governors in May after he was arrested for taking Rs.2 crore as bribe for giving recognition to a medical college in Punjab.

Saha had also written to the conference organisers, who sought documentary evidence to bar Desai from attending the meet.................. IANS/NRIpress.com

MCI chief, Ketan Desai arrested for graft

The Central Bureau of Investigation (CBI) on Thursday arrested Medical Council of India (MCI) president Ketan Desai for allegedly accepting Rs 2 crore as a bribe to grant recognition to a medical college in Punjab

He was arrested with two of his associates/partners, Jitender Pal Singh and Kanwaljit Singh. He accepted the bribe in lieu of  MCI recognition to Gyan Sagar Medical College in Patiala.

The CBI laid a trap after receiving a complaint and caught Singh allegedly with Rs 2 crore, that was to be delivered to Desai
