PUNJAB SET TO PROMULGATE ORDINENCE TO PUNISH THOSE DAMAGING PUBLIC/PRIVATE PROPERTY DURING AGITATIONS-SUKHBIR

 

  • 5 TO 7 YEARS NON-BAILABLE JAIL TERM FOR OFFENDERS
  • RECOVERY OF LOSS TO THE PRROPERTY TO BE RECOVERED FROM CULPRITS

 

Chandigarh, April 15

 

The Punjab Council of Ministers today approved the draft of The Punjab Prevention of Damage to Public and Private Property Ordinance-2010 to ensure the safety of Public/Private property and to punish the rowdy elements damaging these properties during agitations besides recovering the loss caused to the property from the culprits.

Disclosing this here today, Mr. Sukhbir Singh Badal, Punjab Deputy Chief Minister who is also Minister Incharge of Home Affairs Department said that now this Ordinance would be sent to Punjab Governor and after his ascent this would be promulgated for the state of Punjab. Mr. Badal said that Punjab government came out with this ordinance with the sole purpose of protecting the Public and Private property that ordinarily becomes target of ire during public demonstration and agitations.

Mr. Badal said that whosoever would damages public private property defined in section 2(a) would be punished with non-bailable rigorous  imprisonment for a term upto five years with the fine upto Rs. 20,000/-. The Deputy Chief  Minister said that persons committing offence under section 4 by fire or explosive substance would be punished with rigorous imprisonment not less than one year and upto 7 years with a fine upto Rs. 50,000/-.

Giving the details of the  proposed ordinance approved  by the Cabinet ,Mr. Badal said that whosoever was found guilty of any damaging act defined under section 2(e) in addition to sentence imposed, would be liable to pay amount equivalent to the loss caused to the public property as determined by the competent authority . In case of default, the culprit would undergo additional imprisonment upto 2 years.

Mr. Badal said that to make the act deterrent, the offences under the ordinance would be non-bailable and no accused or convicted of an offence under section 4 and 5 of the act would be released on bail or his own bound unless the prosecution has been given an opportunity to oppose the application for such release.

Making special provisions for peaceful conduct of demonstration, Mr. Badal said that the ordinance provided that whosoever wanted to organize peaceful demonstration would make advance application to District Magistrate of the District or the Commissioner of the Police as the case may be, who may allow or refuse permission keeping inveiw circumstances in the district. Mr. Badal said that the permission, if granted ,would specify the   number of persons allowed to hold demonstration, besides place and route of the demonstration/procession.

The participants/organizers would not carry any weapons including Lathis, Knives, Swords, Bhelas, Barchhas, fire arms  and the like. Mr. Badal said that it would be duty of organizers to depute marshals at each relevant junction to organize the participants. The Deputy Chief Minister said that on grant of permission for peaceful demonstration by DM or Commissioner Police, the police officer incharge of District would ensure videography of such protest/demonstration to the maximum extent possible.

Giving the details of the supervisory function of the District Administration Mr. Badal said that the peaceful demonstration so permitted would be supervised by an Officer of the rank  not less than Superintendent of Police and he would immediately inform DM/Commissioner of Police with reports on events including damage, if any caused to the Public/Private property.

Mr. Badal said that offences under the ordinance would be cognizable and any Police Officer not below the rank of Head Constable may arrest any person/persons found to be involved in the commission of such offences.  He said that videographic versions of these incidents recorded to the spot would be considered as sufficient evidence of the offence committed and damage caused to Public/Private property. 

Mr. Badal said that this Ordinance has been passed by the Cabinet on the directions/guidelines of Hon’ble Supreme Court issued on 16-4-2009 in Writ Petition titled Destruction of Public and Private property Vs state of Andhra Pradesh and Others where the Apex Court  had directed the State to take serious note of various instances where there was large scale destruction of public and private properties in the name of agitations, bandhs, hartal and the like. 

The Courts set up to Committee and after accepting the recommendations made by the two Committees the Court issued directions to the states to regulate demonstration, ensure videography of demonstrations and informing the state government with reports on events including damage if any caused during the agitations.

31.36 LAKH TONNES WHEAT PROCURED IN PUNJAB

Chandigarh, April 15:

Government agencies and private millers procured more than 31.36 lakh tonnes of wheat till last evening as compared to 26.64 lakh tones in previous year on the day.

Out of total procurement of 31.36 lakh tonnes of wheat in all the procurement centers of Punjab, Government agencies procured 31.33 lakh tonnes of wheat (99.9%) till date whereas private traders procured 2510 tonnes (0.1%) of wheat. Till April 14, PUNGRAIN had procured 4.73 lakh tonnes (15.1%) whereas MARKFED procured 6.95 lakh tonnes (22.2%). PUNSUP procured 7.61 lakh tonnes (24.3%), PSWC procured 3.48 lakh tonne (11.1%) whereas PAIC was able to procure 3.85 lakh tonnes (12.3%) of wheat.

The Central Government agency FCI had been able to procure 4.69 lakh tonnes (15.0%). 

The spokesman added that District Patiala with 6.37 lakh tonnes of procurement was leading in procurement operations whereas District Sangrur with 4.85 lakh tonnes of procurement was at second slot and district Ferozepur with 3.44 tonnes of procurement ranked at third position.   

The State Government has set up 1650 procurement centers and activated its total machinery to ensure smooth procurement of wheat, the spokesman added.

SUD REVIEWS ARRANGEMENTS MADE FOR CARE AND MANAGEMENT OF NEWLY BORN ZOO ANIMALS NEWL BORN FEMALE CUB NAMED “CHITRA”

 

Chandigarh April 15:

Mr. Tikshan Sud Forests and Wildlife Preservation, Parliamentary Affairs, Medical Education & Research and Labour Minister, Punjab accompanied by Mr. R.C. Nayyar, IAS, Financial Commissioner Forests and Mr. Jitendra Sharma, IFS, Chief Wildlife Warden, Punjab visited the Chhatbir Zoological Park to review the arrangements being made by the Zoo authorities for care and management of the newly borne female Royal Bengal Tigeress.  

The Minister named the new female member of the Zoo's tiger family as 'Chitra' and released her first pictures. He was apprised about the health care and round the clock monitoring being done for Chitra by the zoo authorities. Chief Wildlife Warden, Punjab Mr. Jitendra Sharma, apprised the Minister and Financial Commissioner, Forests about the female cub birth and sequence of events due to which hand rearing had to be started as the most appropriate option for rearing Chitra. Chitra was borne on 02 April 2010, the Good Friday, at 9.38 PM. 

Her mother Chorni, licked, caressed & fed milk to Chitra for first eight days. On 9th day however Zoo-Keepers observed reduced feeding by the mother. Later the feeding was stopped completely. Zoo Director & Veterinarian reached the spot & found the cub weak and distressed. On physical examination-her stomach was found empty. Cub was therefore shifted to zoo hospital on 11-04-2010 at 6 PM for hand rearing on account of the mother's lactating problem. The first diet of goat milk 75ml. (diluted in water) was given 6.10 PM on that day.

The alertness and vigilant eye of zoo management detected the rejection of cub by her mother and the prompt decision to shift the cub for hand rearing saved the cub from starvation. The Minister expressed satisfaction with the arrangements of zoo for hand rearing of Chitra as her mother was not lactating satisfactorily.

He took very keen interest in the conservation breeding programme of tigers being run by the zoo on scientific lines to maintain a varied and healthy gene pool for the breeding programme. He was informed that another Royal Bengal Tiger of South Indian origin is in process to be acquired by the Zoo to have a more diverse gene pool for breeding tigers. 

Mr. R.C. Nayyar, IAS, Financial Commissioner Forests and Wildlife Preservation informed the media persons that recently many species hosted at the Zoological Park, namely Goral, White Buck, Barking Deer, Hog Deer, Bonnet Monkey, Jackal, Painted Stork have given birth to new off springs. Egg laying by many pheasants namely Silver Pheasant, Golden Pheasant, Red Jungle Fowl, Mangolian Pheasant and grey partridge has taken place in zoo after measures were taken more careful regulation of entry of visitors in the pheasant zone and specific food supplements having been introduced for these birds.

He further informed that reptiles in zoo i.e. Python and Monitor Lizard, which were hibernating since the on-set of winter and were being kept in a separate room with thermoregulatory mechanism, have now been released in their display enclosures.
