The 12th June, 2008

No.SEC-ME-2008/575 .- In exercise of the powers vested by Sub-Section (1) of Section 13-A of the Punjab Municipal Act, 1911 (as amended by Act of 1994), the Principal Secretary to Govt. Punjab, Department of Local Government vide its Notification No.3/4/2008/MEO/EA/1967, dated 23.5.2008 has directed that the general elections to elect member of the urban Local Bodies and bye-election to elect one member from Ward No.3 of Nagar Panchayat, Dhilwan be held on any single day by 29th June, 2008.

2. Now, therefore, in pursuance of the provisions contained in Section 35 of the Punjab State Election Commission Act, 1994 (Punjab Act No.19 of 1994) the State Election Commission, Punjab hereby appoints the following dates for general election to elect members of Municipal Councils/Nagar Panchayats and bye-election to elect member of Nagar Panchayat, Dhilwan, shown in the enclosed Schedule with 12th, June, 2008 as the first day of filing nominations :-

PROGRAMME

(a) 17th June, 2008 (Tuesday)

as the last date for making nominations;

(b) 19th June, 2008 (Thursday)

as the date for the Scrutiny of nominations;

(c) 20th June, 2008 (Thursday)

as the last date for withdrawal of candidatures;

(d) 30th June, 2008 (Monday)

as the date on which a poll shall, if necessary be taken and;

(e) 3rd July, 2008 (Wednesday)

as the date by which the election shall be completed.

In pursuance of the provisions of Section 57 of the Punjab State Election Commission Act, 1994 (Punjab Act No.19 of 1994), the Election Commission hereby fix poll hours from 8.00 AM to 4.00 PM during the poll on 30.6.2008 to conduct the general election of Municipal Councils/Nagar Panchayats and bye-election to elect member of Nagar Panchayat, Dhilwan shown, in the enclosed schedule.

No.SEC-M.Corpn.-2008/ 573 .- In exercise of the powers vested under Sub-Section (1) of Section 7-A of the Punjab Municipal Corporation Act, 1976, the department of Local Government, Punjab (Municipal Election Office) vide Notification No.3/4/2008/MEO/EA/1944, dated 22.5.2008 has directed that the general election to elect Councillors of Municipal Corporation, Bathinda and bye-election to elect one councillor from Ward No.41 of Municipal Corporation Jalandhar shall be held on any single day by the 23rd June, 2008.

Numbers of complaints referred to Deputy Commissioner, Ferozepur regarding rejection of nomination papers. District Electoral Oficer, Ferozepur has got the complaints enquired into by senior officers. Thereafter, he has sent the recommendations of the enquiry officer's alongwith his specific observations in the letters under reference. Number of complaints has been recommended to be filed and the recommendations of Deputy Commissioner, Ferozepur are accepted. In other complaint petitions the District Electoral Officer has recommended countermanding on serious grounds.The Commission has considered the recommendation of the enquiry officer and the report of District Electoral Officer, Ferozepur. It is found that poll process has been vitiated and election toe the Gram Panchayats as mentioned below, are countermanding:-

District Electoral Officer, SAS Nagar has intimated that the Department of Rural Development and Panchayat vide Memo dated 23.05.2008 has revised the number of panchs/ reservation of Gram Panchayat Nimbuan. This revision raises the number of Panches in general category. However, the nomination papers had been received and dummy ballot papers sent for prining prior to the receipt of the above mentioned letter of the Department of Rural Development. Accordingly the District Electoral Officer has recommended for countermanding of poll to Gram Panchyayat Numbuan Block Dera Bassi. Commission after due consideration accepts the report of the District Electoral Officer SAS Nagar and countermands the poll of Village Nimbuan and fresh election schedule shall be issued separately.

2. Sub Divisional Magistrate Khanna has reported that the complaint referred to him by the State Election Commission has been inquired into by the Tehsildar Payal. As per statement of the Returning Officer Smt. Harjinder Kaur wife of Shri Gurcharan Singh had filed nomination papers correctly but by mistake the Returning Officer put it in the list of rejected nomination papers. The list of nomination papers rejected on 18.05.2008 and 19.05.2008 were different. The Returning Officer has admitted his mistake. Evidently the poll process has been vitiated. Accordingly, election to Gram Panchayat Village Jogi Majra is countermanded and fresh election schedule shall be issued separately. This issues in exercise of the powers vested with the State Election Commission under Article 243K and 243N of the Constitution of India. The Sub Divisional Magistrate after enquiry has reported that the candidate Shri Pal Singh son of Shri Sardara Singh resident of Village Bikhindi Block Majri has enclosed BC certificate, but the same was not included in the nomination paper. The candidate had complained that the Returning Officer had put the cross mark in his nomination paper against BC category and put mark in the general category to benefit the opposing candidate. Evidently the poll process has been vitiated and the election to Cluster No.7 Block Majri district SAS Nagar is countermanded and fresh election schedule shall be issued separately. As reported by the District Electoral Officer, Gurdaspur vide memo under reference, the Sub Divisional Magistrate, Batala has stated that nomination paper of Dayal Singh son of Surta Singh, Sukhwinder Kaur wife of Sawinder Singh, Inderjit Kaur wife of Inderjit Singh, Gian Kaur wife of Jagdish Singh and Narinder Singh so of Karnail Singh have been wrongly rejected. The Sub Divisional Magistrate Batala has recorded that the rejection was on inconsequential grounds including clerical error, lack of addresses of witnesses , non enclosure of documents which were not required, etc. The Returning Officer has rejected the nomination papers in irresponsible manner and with malafide intent. The poll process has been vitiated and election to Gram Panchayat Bhagwanpur is countermandde and fresh election schedule shall be issued separately. It is accepted that the nomination papers of Gram Panchayat Village Jiwan Pandher were rejected without substantial reasons., Infact the nomination papers have been shown as withdrawn after allotment of symbols. This proves the malafide and criminal action of Returning Officer. The poll process is vitiated and the election to Gram Panchayat Village Jiwan Pandher Block Tarsikka district Amritsar is countermanded and fresh election schedule shall be issued separately. This issues in exercise of the powers vested with the State Election Commission under Article 243K and 243N of the Constitution of India. Disciplinary proceedings for charge sheet of Returning Officer be initiated. Returning Officer be kept under suspension immediately and proceedings be initiated for imposition of major punishment.

However, by clerical mistake SC category has been mentioned in the ballot paper. At this stage category in the ballot paper cannot be changed from SC to General category. 2. A complaint was forwarded to the Election Observer vide Memo No.SEC-08/7499 dated 21,05.2008 and the Observer in return sent report vide memo under reference. On the basis of report the polling process has been vitiate in village Jhuneer Block Jhuneer and Village Fatehpur Block Jhuneer. Accordingly the poll of these two villages is countermanded and fresh and fresh election schedule shall be issued separately.

Since the Panchayat poll is scheduled to be held on 26.05.2008, therefore, the above directions are communicated to the District Electoral Officer/ Additional District Electoral Officer for immediate compliance. The detailed orders, alongwith action, if any, to be taken against the Returning Officer, shall be communicated lateron.

The election process of Gram Panchayat Village Panniwala Fatta Tehsil Malout district Muktsar has been vitiated. Therefore the Election to Gram Panchayat Village Panniwala Fatta is countermanded and fresh election schedule shall be issued separately.

Number of complaints were referred to the District Electoral Officer -cum- Deputy Commissioner, Ferozepur by the State Election Commission, Punjab. Some complaints were also received by him. He has got the complaints inquired into by senior of the district Ferozepur. Number of complaints regarding rejection of nomination papers have been recommended to be filed and these recommendations have been accepted. However, on the basis of recommendations/ observations of Enquiry Officer and the District Electoral Officer it is concluded that purity and sanctity of poll process has been vitiated and the election in following Gram Panchayats is countermanded and fresh election schedule shall be issued separately.

ORDER:
Shri Surat Singh son of S. Santokh Resident of Village Hassanpur had represented to the State Election Commission on 13.05.2008 that his name from the electoral rolls was found missing when he went to exercise his right of franchise on the day of poll for the elections to Panchayat Samitis and Zila Parishads. He has represented to the Commission that he is a legitimate resident and voter of the village and his name very much figured in the electoral rolls prepared for the Legislative Election for the year 2007. He had categorically mentioned in writing that he is a candidate for the Panchayat Elections and accordingly his name may please be ordered to be included in the electoral rolls. The concerned ERO was asked by the Commission vide Endst. No.SEC-08/5655 dated 13.05.2008 to take immediate action as per rules. On the endorsement of his application the BDPO while observing recommended that his name figures at Sr. No.1599 and could not be included inadvertently in the final list, duly recommended to the ERO to include his name on 15.05.2008, but the SDM-cum-ERO seemingly had made that needless quarries on 15.05.2008 and even after repeated clear recommendations of the BDPO protracted on the matter and finally cleared file on 17.05.2008. Thereafter even report of the ADC(D) who had admitted in his memo dated 21.05.2008 that error is advertant whereas he is clarified to be enrolled as an elector in the rolls.
Shri Surat Singh is repeatedly appeared before me and has alleged that he is being intentionally deprived of his right to contest the election as some vested interests are conspiring to thwart him to contest the election which is his fundamental right.
Constitution of India and the State Election Commission Act mandate the SEC to superintendence direction and control of the preparation of electoral rolls for, and the conduct of all elections to Panchayats. Obviously it devolves of the Commission to ensure that the same are conducted fairly and honestly. In the instant case the circumstances and the record placed before me suggests that Shri Surat Singh has been deprived of right of franchise. After due consideration, Commission concludes that the poll process has been vitiated and the election to Village Hassanpur is countermanded and fresh election schedule shall be issued separately.
